Terms & Conditions

Please read these Terms and Conditions carefully before engaging our services. By proceeding with any order or payment, you confirm that you have read, understood and agreed to these terms.
1. Parties
These Terms and Conditions constitute a binding agreement between Destinos Online (Pty) Ltd (Registration No. 2022/668257/07), trading as Destinos.dev, with registered address at 40 Stasie Way, Calvinia, Northern Cape, 8190, South Africa ("we", "us", "our") and the person or entity engaging our services ("you", "the client").
2. Services
We provide web design, web development, custom platform development, website hosting, professional email hosting, SEO services, website care plans, and related digital services. The specific scope of services will be agreed upon in writing prior to commencement of any project.
3. Quotations and Payments
All quotations are valid for 30 days from the date of issue. Once a quotation is accepted, a deposit of 50% is required before work commences, with the balance due upon completion. Monthly services (hosting, care plans, SEO) are billed in advance and are due on the 1st of each month. Late payments may attract interest at the prime lending rate plus 2%. We reserve the right to suspend services for accounts overdue by more than 14 days.
4. Project Delivery
Estimated delivery times are provided in good faith. Delays caused by the client (including delayed feedback, content, or approvals) may extend delivery timelines. We will communicate any delays promptly. Rush delivery may be available at an additional charge.
5. Client Responsibilities
The client is responsible for providing accurate content, images, and information required for the project. The client warrants that all content provided does not infringe any third-party intellectual property rights. The client is responsible for reviewing and approving all work before final publication.
6. Intellectual Property
Upon receipt of full payment, the client receives full ownership of the final website design and content. We retain the right to display completed work in our portfolio. All third-party software, plugins, themes, or stock images remain subject to their respective licences. We retain ownership of any proprietary tools, frameworks, or code libraries developed independently.
7. Hosting Services
Website hosting is provided on a monthly basis. We aim for 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance where possible. Hosting fees are non-refundable. The client is responsible for ensuring their website content complies with all applicable laws.
8. Care Plans
Care plan services include the specific items outlined in the chosen plan. Support hours are allocated monthly and do not carry over. Emergency support outside of allocated hours may be available at our standard hourly rate. Care plans do not cover damage caused by the client, third-party plugins, or security breaches resulting from the client's actions.
9. Cancellation
Monthly services may be cancelled with 30 days written notice to hello@destinos.dev. Once-off project deposits are non-refundable if work has commenced. Cancellation of a project mid-way will result in a pro-rata charge for work completed. We reserve the right to terminate services immediately if the client breaches these terms.
10. Limitation of Liability
Our total liability to the client shall not exceed the total amount paid by the client in the 3 months preceding the claim. We are not liable for indirect, consequential, or special damages including loss of profits, loss of data, or loss of business. We are not liable for any damages resulting from third-party services, plugins, or hosting infrastructure.
11. Confidentiality
Both parties agree to keep confidential any sensitive business information shared during the course of the relationship. This obligation survives termination of the agreement.
12. Governing Law
These Terms and Conditions are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the South African courts.
13. Changes to These Terms
We reserve the right to update these Terms and Conditions at any time. Continued use of our services after changes are published constitutes acceptance of the updated terms. We will notify clients of material changes by email.
