Terms of Service

By engaging Destinos Online (Pty) Ltd ("Destinos", "we", "us") or using any service offered through destinos.dev, you ("Client", "you") agree to be bound by these Terms of Service. If you do not agree, do not use our services.

We provide web design, custom platform development, managed hosting, professional email, SEO, and related digital services as described on destinos.dev. The specific scope of work for each engagement is agreed in writing prior to commencement.

We reserve the right to decline, suspend or terminate any project at our sole discretion if we determine that the requested content or purpose is unlawful, harmful, or contrary to our values.

Once-off projects (e.g. custom builds): a deposit of 50% is required before work begins; the balance is due upon completion and before handover or go-live. Quoted prices are valid for 30 days.

Monthly retainers (hosting, care plans, subscriptions): billed monthly in advance. Payment is due on the invoice date. A 7-day grace period applies; services may be suspended after 14 days of non-payment.

All prices are in South African Rand (ZAR) and exclusive of VAT unless stated otherwise. We accept EFT, Visa, Mastercard, and Yoco.

Monthly services: cancel with 30 days' written notice. No refunds are issued for partially used billing periods.

Project work: if you cancel after work has commenced, you remain liable for all work completed to date, calculated at our standard hourly rate against the deposit paid. If the deposit does not cover hours worked, an invoice for the balance will be issued.

We may terminate services for repeated late payment, abusive conduct, or breach of these Terms, with 7 days' written notice (or immediately where unlawful conduct is involved).

Upon receipt of full payment, all custom-designed deliverables (website design, graphics, copy created by us on your behalf) are assigned to you. We retain the right to display completed work in our portfolio unless you request otherwise in writing.

All source code, frameworks, libraries and third-party components remain subject to their respective licences. Destinos retains ownership of any reusable internal tooling or modules.

You warrant that all materials, images, content and brand assets you provide to us are owned by you or that you have the necessary rights to use them.

We target 99.9% uptime on managed hosting plans. Scheduled maintenance is announced in advance where possible. Downtime caused by third-party infrastructure providers, DDoS attacks, or circumstances beyond our control is excluded from uptime calculations.

You are responsible for maintaining current backups of any content you upload unless a specific backup service is included in your plan.

To the maximum extent permitted by law, Destinos's total liability for any claim arising out of or relating to these Terms or our services shall not exceed the fees paid by you in the three months preceding the claim.

We are not liable for indirect, incidental, consequential or special damages, including loss of revenue, loss of data, or loss of business opportunity, even if advised of the possibility of such damages.

We warrant that services will be performed with reasonable skill and care. We do not warrant that websites will achieve specific search rankings, conversion rates, or business outcomes.

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts of South Africa. We encourage informal resolution first — please contact us at hello@destinos.dev before initiating legal proceedings.

We may update these Terms from time to time. Continued use of our services after notice of changes constitutes acceptance of the updated Terms.
